The comparison seems fair, but I'm wondering really how much legitimate bit-torrent stuff goes on that would be indexed by a site like TPB. Yes, torrents are used by Blizzard and Twitter for their own internal operations, but I'm guessing that anyone who is going to work with those torrents are doing so through the parent sites, not through a search engine. I'm having a hard time coming up with any use for TPB other than finding and downloading material that has a decent chance of violating copyright law. Google and YouTube, on the other hand, both seem to have useful and legitimate files. Does TPB?

Really enlightening comparison between The Pirate Bay and Google's torrent search functionality. Interestingly, Google's torrent search functionality is incredibly similar to IsoHunt, which as I'm sure you know was recently found liable for secondary copyright infringement even though it "has a history of complying with DMCA takedown notices" (at least according to Wikipedia).

I thought that after Grokster the biggest case against P2P services was that they *induced* infringement? Clearly the bar for establishing that has been set pretty low, but liability isn't all about the service provider/user distinction.
